Wills and Related Documents

 

Your Last Will and Testament is important for distributing your assets to your loved ones.  Did you know that there are actions you can take to allow assets to pass outside of your Will without court involvement?  Let me tell you about them.

There are other important documents that we should discuss, as well, and can be included as part of a package for you:

  • General Durable Power of Attorney:  names agents who can manage your property for you while you are still alive, as you choose - either as a convenience or because you are incapable of doing so.

  • Advanced Directives for Health Care:  names agents who are authorized to provide direction to health care providers in the event you are unable to, and includes guidance and your wishes for your agents to take into consideration when providing that direction.

    We will work together to develop the most effective plan and package to achieve your goals and objectives.


Trusts

 

There are many reasons to use trusts, and many types of trusts.  A couple that you might be familiar with and we may want to discuss are:

  • Revocable Living Trusts - used for privacy, avoidance of probate in one or multiple jurisdictions, and minimizing the costs of administration.

  • Supplemental Needs Trusts - used to preserve government benefits for loved ones and provide for expenses not covered by those benefits.  If you have family members who are or may be entitled to such benefits, let’s discuss your special planning needs.

As we discuss your circumstances and goals we will discuss trusts that will enable us to be achieve your desired results.


Estate Planning            

While the current thresholds for the federal estate tax don’t require planning around it for many people, there are many other planning opportunities to take advantage of:

  • Different planning and strategies for different asset types

  • Blended family planning

  • Special needs planning

  • Income tax planning
